What Is Subcontractor Superannuation and When Does It Apply?

In Australia, superannuation isn't reserved exclusively for full-time employees. Under the Superannuation Guarantee (Administration) Act 1992, independent contractors who operate under an ABN can be classified as "employees for superannuation purposes."

This law applies whenever a contract is deemed to be wholly or principally for the labour of the person. If you contract a sparky, plumber, or chippy to complete work and they perform the physical labour themselves without delegating it to their own employees, you are legally obligated to pay 12.0% super guarantee on top of their invoice.

Who Must Pay Super Guarantee for Subcontractors?

As a builder, principal contractor, or business owner, the legal burden to calculate and pay super guarantee rests on your shoulders. The ATO applies the "Principally for Labour" Test:

  • Labour-Only Contracts (Super Applies): If you supply the timber, cable, tools, and materials, and the subbie simply provides their time and trade skills, the contract is 100% labour. Super guarantee applies.
  • Result & Material Contracts (Super Exempt): If a subbie provides heavy machinery, scaffolding, bricks, mortar, and quotes a fixed lump-sum price for a completed result, they are supplying materials and equipment. Super guarantee does NOT apply.

How to Calculate Subcontractor Super Guarantee: Step-by-Step

  1. Step 1: Identify Gross Payment: Find the gross invoice payment amount due to the subcontractor.
  2. Step 2: Check GST Registration: If the subbie is registered for GST, exclude the 10% GST component. If not registered, use the full gross invoice value. Calculate GST with our Australian GST Calculator.
  3. Step 3: Apply the 12.0% SG Rate: Multiply the GST-exclusive base by 12.0% (FY 2026-27 rate).
  4. Step 4: Remit via SuperStream: Transfer the funds to the worker's nominated super fund using the ATO's free Small Business Superannuation Clearing House (SBSCH).

GST & Super Base: How GST Affects Your Payments

Super Guarantee is calculated strictly on the GST-exclusive value of the labour contract:

  • Subbie Registered for GST: Invoice = $1,100 ($1,000 labour + $100 GST). Super Base = $1,000. Super Payable = $120.00 (12% of $1,000).
  • Subbie NOT Registered for GST: Invoice = $1,000 (No GST). Super Base = $1,000. Super Payable = $120.00 (12% of $1,000).

Super Guarantee Charge (SGC) Penalty Warning

If you miss an ATO quarterly super deadline, you lose the ability to claim super as a tax deduction. Furthermore, the ATO applies the Super Guarantee Charge (SGC), which includes:
